The Workers' Compensation Act in North Carolina requires that companies or persons who employ more than three people carry workers' compensation insurance. To protect employees from the expense of injury incurred on the job, the workers' compensation system was designed. The following expenses are covered by workers' compensation to which you are entitled:
- Income from missing work
- Income from inability to work due to permanent disability
- Medical expenses due to injury or illness contracted on the job
- Compensation for permanent damages, which includes disfigurement and damages to organs
Under the North Carolina workers' compensation law, you can receive workers compensation for three types of occurrences:
- occupational diseases - an illness or disease whose onset was facilitated by conditions on the job, and whose incidence in the employees' field of work is higher than the incidence in the general population as whole.
- on the job accidents - occurrences that happen unexpectedly during the course of ordinary performance of regular job duties, such as slipping and falling.
- specific traumatic incidents that occur on the job - these are due to job duties and frequently include herniation or chronic back pain induced from heavy lifting
In a typical case, people receiving workers compensation are eligible to receive two-thirds of their weekly salary for the duration of their disability. In instances of permanent disability, the State Legislature of North Carolina has determined a set number of weeks for which a worker is eligible receive North Carolina workers' compensation benefits. This is statutory and proceeds from a set schedule.
